IBIS Financial Corporation – Mobile App Disclaimer and Consent Agreement

PLEASE READ THIS AGREEMENT CAREFULLY. This comprehensive legal disclaimer and user agreement (“Agreement”) governs your use of IBIS Financial Corporation’s mobile banking and mortgage services application (the “App”). By downloading or using the App, you acknowledge that you have read and agree to all of the following terms, disclosures, and consents.
E-Sign Disclosure and Consent
Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), you agree to receive all communications, disclosures, and agreements from IBIS Financial Corporation electronically rather than in paper form. By using the App or tapping “I Agree” when prompted, you consent to conduct business electronically. Your electronic signatures and acknowledgments are legally binding and have the same effect as handwritten signatures. If you do not consent to electronic records, do not use the App. Withdrawal of consent may result in loss of access to App services.
Electronic Communications and Records
You consent to the electronic delivery of all documents and records related to your accounts and services with IBIS Financial Corporation. These include:
● Legal disclosures, loan estimates, closing documents, and privacy notices
● Loan applications, promissory notes, mortgage/deed documents
● Property inspection reports, appraisals, and related records
● Account statements, payment receipts, and customer service correspondence
● Any updates or notifications relating to your use of the App
Electronic delivery through the App, email, or secure links satisfies any requirement for written communication. You agree to keep your contact information up to date.

Loan and Mortgage Disclosures
No Final Approval or Commitment: Any pre-qualification or rate quote is preliminary and not a guarantee of approval. All applications are subject to full underwriting and verification. Conditional Approval: Any estimate or conditional approval remains subject to further review and satisfaction of conditions. IBIS Financial Corporation reserves the right to deny any application at its sole discretion.
No Guarantee of Terms: Not all applicants will qualify. Terms may change. Final loan terms will be detailed in executed documents.
No Financial Advice: App content does not constitute financial, legal, or tax advice. Consult a qualified professional for personal guidance.
GPS Tracking Consent
Some App features may require GPS access to facilitate services such as remote inspections. By enabling location services, you consent to the collection and use of your geolocation for business purposes only. You can revoke GPS access at any time through your device settings, though doing so may limit certain functionality.
Privacy Notice and Data Usage
Use of the App is subject to IBIS Financial Corporation’s Privacy Policy. We collect personal data such as identity, financial, and device information to process loan requests, verify identity, manage accounts, and maintain security. Your data may be shared only with trusted providers as required to deliver services. We do not sell your personal data. Usage tracking tools may be used for security and service optimization. Terms of Use and Limitation of Liability
You agree to use the App lawfully and responsibly. IBIS Financial Corporation makes no guarantees of uninterrupted service and disclaims all warranties to the fullest extent permitted by law. In no event shall IBIS be liable for any indirect, incidental, or consequential damages arising from use of the App. If dissatisfied, your sole remedy is to stop using the App.
Release and Indemnification
You agree to release and indemnify IBIS Financial Corporation from any losses arising from your misuse of the App or breach of this Agreement, except where caused by IBIS’s gross negligence or willful misconduct.
Privacy Notice under the Gramm-Leach-Bliley Act (GLBA):
By proceeding with this application through IBIS Financial Corporation, you acknowledge and agree that we may collect, use, and share your nonpublic personal information as permitted by law. This includes information you provide (such as name, address, income), information from transactions (such as account balances or payment history), and information from consumer reporting agencies.

We maintain physical, electronic, and procedural safeguards to protect your personal information. Your data may be shared with affiliated and non-affiliated third parties only as necessary to process your loan application, service your loan, or as otherwise permitted by law.
Fair Credit Reporting Act (FCRA) Authorization:
By submitting this application through IBIS Financial Corporation, you authorize us to obtain and use your credit report and other credit-related information from one or more consumer reporting agencies. This information will be used to evaluate your eligibility for credit and determine appropriate loan terms.
You also authorize us to share this information with affiliated third parties, potential lenders, servicers, and investors for purposes related to processing, funding, and servicing your loan. You have the right to request whether a consumer report was obtained and, if so, the name and address of the agency that provided it. Providing false information in this application may be considered fraud and is subject to penalties under federal law.
